HOW TO KEEP YOUR ORGANIZATION AND YOURSELFOUT OF COURT
There are three major bodies of law applicable when dealing with ill, injured or disabled workers. Two are federal laws: the Americans with Disabilities Act and the Family and Medical Leave Act. The third, workers compensation laws, are state laws and will vary from state to state. The workers compensation laws for each state can be found in the statutes in your particular state. In this paper I attempt to provide you with a broad look at the Americans with Disabilities Act and the Family and Medical Leave Act to assist you in maneuvering through them if an issue under either arises with respect to an employee. I also provide a very brief explanation of workers compensation. My presentation will focus on the bottom line with respect to the ADA and FMLA, discuss some conflicting requirements of the two acts, and give you some practical tips on avoiding liability under these laws.
